利用規約

1. 本規約について

本規約は、個人開発者（以下「当方」）が提供する iOS アプリケーション「TrafficCount」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなします。

2. ライセンス

当方は利用者に対し、Apple の App Store 利用規約にしたがって本アプリを個人的または業務上で利用する、譲渡不能・非独占のライセンスを許諾します。本アプリの複製、改変、逆コンパイル、再配布は認められません。

3. 無料でご利用いただける範囲

本アプリは、1日あたり10回まで解析（ライブ計測の開始、動画1本の解析、写真バッチ1回）を無料でご利用いただけます。回数は端末の日付が変わるとリセットされます。動画の解析は、無料プランでは1本あたり5分までです。

過去の調査結果の閲覧、グラフの表示、Excel・CSV の書き出しは、回数にかかわらず無料でご利用いただけます。

4. サブスクリプション

• 名称: TrafficCount Pro（月額）
• 内容: 1日あたりの解析回数の上限が無くなり、動画1本あたりの解析可能な長さが5分から60分に延長されます
• 動画の長さの上限: サブスクリプションに加入していても、60分を超える動画は解析できません。1時間近い解析は端末を占有し続けたまま発熱させるため、端末を保護する目的でこの上限を設けています
• 価格: 月額 500円（税込・日本のストアの場合）。その他の国と地域の価格は、App Store 上の表示にしたがいます
• 無料トライアル: 3日間。トライアル期間中に解約すれば料金は発生しません
• 更新: 期間終了の24時間前までに解約されない限り、自動的に更新されます
• 課金: 購入の確定時、および更新のたびに、利用者の Apple ID に課金されます
• 解約: iOS の「設定」→ Apple ID →「サブスクリプション」からいつでも解約できます。解約は次回更新日から有効になり、それまでの期間はご利用いただけます
• 返金: 返金は Apple の方針にしたがいます。当方は決済を扱っていないため、返金の可否を判断できません

5. 計測結果の精度について（重要）

総通過数は、機械学習による自動検出で検出・カウントした値です（誤検出・検出漏れが生じることはあります）。これに対して性別・年齢層は推定であり、測定値ではありません。以下の点を必ずご理解のうえご利用ください。

• 通過数は検出・カウントした値であり、混雑・逆光・遮蔽・カメラの位置・解像度などの条件による誤検出・検出漏れによって、実際の人数と異なることがあります
• 性別と年齢層は推定です。同梱のサンプル映像で実測したところ、顔を検出できた歩行者の割合は撮影条件によって0.5%〜16.1%にとどまり、顔が小さい条件では年齢6区分の正解率はおおむね41〜43%程度です。判定できなかった場合は「不明」として記録されます
• 設定で「最も確からしい区分へ割り当てる」を選んだ場合、判定できなかった人は統計的な推定によって区分へ割り当てられます。この値は測定値ではありません。該当する行には推定である旨の印が付き、書き出したファイルでも実測値と分けて出力されます
• 本アプリの出力は、そのまま公的な統計、法的な判断、安全に関わる判断の唯一の根拠として用いることを想定していません。重要な用途では、目視による検証と併用してください

6. 撮影と記録に関する利用者の責任

公共の場所を含む場所での撮影および人物の記録には、国・地域ごとの法令および施設の規則が適用される場合があります。撮影の可否、必要な許可の取得、記録および出力したデータの取り扱いは、すべて利用者の責任となります。当方は、利用者による本アプリの利用が適法であることを保証しません。

7. 禁止事項

• 法令または公序良俗に違反する目的での利用
• 特定の個人を追跡・監視する目的での利用
• 本アプリの解析、改変、リバースエンジニアリング
• 本アプリの動作を妨げる行為

8. 免責

本アプリは「現状有姿」で提供されます。当方は、本アプリが特定の目的に適合すること、中断なく動作すること、計測結果が正確であることを保証しません。本アプリの利用または利用不能によって生じた損害について、当方は、適用される法令が許す最大限の範囲で責任を負いません。

9. データの保存

調査データは利用者の端末内にのみ保存されます。当方はバックアップを保持していないため、端末の紛失・故障・アプリの削除によって失われたデータを復元することはできません。重要なデータは、Excel・CSV への書き出しにより控えを取ってください。

10. 本規約の変更

当方は本規約を変更することがあります。変更後の規約は本ページに掲示した時点で効力を生じます。

11. 準拠法

本規約は日本法に準拠します。

1. About these terms

These terms govern your use of TrafficCount (the "App"), an iOS application provided by an independent developer ("we"). By downloading or using the App you agree to them.

2. Licence

We grant you a non-transferable, non-exclusive licence to use the App for personal or business purposes, subject to Apple's App Store Terms of Service. You may not copy, modify, decompile or redistribute the App.

3. What is free

You may start up to 10 analyses per day at no charge (starting a live count, analysing one video, or one batch of photos). The allowance resets when the date changes on your device. On the free plan, video analysis is limited to videos up to 5 minutes long.

Viewing past surveys, charts, and exporting to Excel and CSV are always free, regardless of the allowance.

4. Subscription

• Name: TrafficCount Pro (Monthly)
• What it does: removes the daily limit on analyses, and raises the per-video length limit from 5 minutes to 60 minutes
• Video length cap: even with a subscription, videos longer than 60 minutes cannot be analysed. An analysis that long would occupy your device for close to an hour while it heats up, so this cap exists to protect your device
• Price: JPY 500 per month in the Japanese storefront. Prices in other regions are as shown on the App Store
• Free trial: 3 days. Cancel during the trial and you are not charged
• Renewal: renews automatically unless cancelled at least 24 hours before the end of the current period
• Billing: your Apple ID is charged on confirmation of purchase and on each renewal
• Cancelling: cancel any time in iOS Settings → your Apple ID → Subscriptions. Cancellation takes effect at the next renewal date; access continues until then
• Refunds: refunds follow Apple's policy. We do not process payments and cannot decide refunds

5. Accuracy of the results (important)

Crossing counts are values the App detects and counts using automated machine-learning detection (missed or false detections are possible). Gender and age group, by contrast, are estimates — not measurements. Please understand the following before relying on them.

• Crossing counts are detected and counted values that may differ from the true number of people, due to missed or false detections caused by crowding, backlight, occlusion, camera position and resolution
• Gender and age group are estimates. On the sample footage bundled with the App, the share of pedestrians whose face could even be detected ranged from 0.5% to 16.1% depending on the scene, and where faces are small, 6-bucket age accuracy is only around 41–43%. When gender or age cannot be determined, it is recorded as unknown
• If you select "assign to most likely bucket" in Settings, undetermined people are allocated to buckets by statistical estimation. Those values are not measurements. Such rows are flagged as estimated and are exported separately from measured values
• The App's output is not intended to be the sole basis for official statistics, legal determinations, or safety-critical decisions. For important uses, verify against manual observation

6. Your responsibility when recording

Recording people, including in public places, may be subject to laws and to the rules of the venue where you are. Whether you may record, obtaining any permissions required, and how you handle recorded and exported data are entirely your responsibility. We make no representation that your use of the App is lawful in your jurisdiction.

7. Prohibited uses

• Use for any purpose that violates law or public order
• Use to track or monitor specific individuals
• Analysing, modifying or reverse-engineering the App
• Interfering with the operation of the App

8. Disclaimer

The App is provided "as is". We do not warrant that it is fit for any particular purpose, that it will operate without interruption, or that its results are accurate. To the fullest extent permitted by applicable law, we are not liable for any damages arising from the use of, or inability to use, the App.

9. Data storage

Survey data is stored only on your device. We keep no backup and cannot recover data lost through a lost or broken device, or through deleting the App. Export important data to Excel or CSV to keep your own copy.

10. Changes to these terms

We may revise these terms. Revised terms take effect when posted on this page.

11. Governing law

These terms are governed by the laws of Japan.
